Form I-9

What is a Form I-9?

Ever since the passage of the Immigration Reform and Control Act in November of 1986, everyone who has been hired from that date on must complete Form I-9 to prove that they are an authorized worker. Every business is required to prove the identity and work authorization of each employee through the completion of a Form I-9, and failure to do so may result in penalties such as fines, incarceration, asset seizure, and more.

While it is the employer who is ultimately responsible for completing the Form I-9 correctly, it is the worker who must provide the accurate and right documentation. There are three sections of the form and the entire form must be completed within the first three days following the date of employment. Section 1, which the employee must fill out, must be signed and completed on or before the first day of employment. Employers are responsible for filling out Section 2, which involves examining the evidence of identity and employment authorization of the potential employee. Section 2 must be completed within three days of the date employment begins, and even recruiters and referrers for a fee are required to complete this form if they are agricultural associations, farm labor contractors or agricultural employers.

There are certain evidences of proof that must be included in Section 2, such as the document title, issuing authority, document number, expiration date (if any), and the date employment begins.
